Twelcon manufactures worlds safest electricity enclosures, next to being able to hold advertising content as well.

THE LEGAL PROBLEM OF ARTIFICIAL INTELLIGENCE

For (not only) insurance companies

Whereas everybody is quite excited on the tech side of Artificial Intelligence there is a problem...and that is the legal issues that are created by using- and applying these AI techniques
When illustrating this with an example one can already see the legal problems arising;

When in 2012 a police man drove up and stopped a luxurious car with a African man of not even 20 years, this policeman was publicly condemned for  "profiling". The Police Department was actually ordered to stop by the Justice Department because, although the risk profile of the -car, man and age- combination was quite high, it was in itself not correct and discriminative to act on these premonitions.
In 2018 the Police in that same country installed nearby a notorious pickpockets area of an premium brands outlet center on all roads approaching this center camera's connected to a bunch of computers actually predicting the chance of which cars would contain the pickpockets. Where an algorithm predicted the chance of an approaching car would contain pickpockets, the police stops and searches the vehicles. Beware that the Police as searching for, as they stated, a highly probability of finding pickpockets when a car contains more than 3 Rumanians and the car is a German rental car.....
Everybody thought this to be a good initiative, where instead of trying to catch the thieves and pick pockets  when they already have committed the crime, the Police was trying to prevent the crime...
Apparently a lot has changed in publics opinion since 2012....

What has changed or can change when using AI
The change therefor is the respons of somebody or something on the basis of a prediction. A computer programmed to look for the possibilities, changes and risk in advance.  While in itself profiling can be helpful, it can be simple but serious legal problem.
All laws, well most of the respectable countries laws, are based on the fact that the law rules on basically two things; what is and isn't allowed and what is the penalty when a law is not obeyed...

To start on the most simple one; can Justice enforce laws who are prevented by AI? Can a person be denied the access to a Outlet Center on the sheer fact that he rented a car in Germany? The answer is clearly no. So why bother in trying to prevent it..? Can a policeman even stop this car...in 2012 he couldn't.
Can a Policeman actually try to find out if this is a criminal this way...also a clear no; he would be severely invading this person's privacy...another great law.

So there is a problem when enforcing and acting on AI when used for predictions

For insurance companies, what about AI?
Clearly it is the dream of any insurance company to predict all risks. Because it will lower their risk as well and, without any doubt, will have them make more profits.
​They can use all data available and predict and specify the risk. and adjust the policy costs to that risk profile.
And even better, they can start very focussed campaigns on specific customer groups (till the level of even a (one) person) to lower the risks... on accidents, fire, health problems etc.
Thats is not a challenge, it is their job.

But here is the legal catch;
An insurance company client has to give the company all information decently needed for the company to be able to calculate the risk. For a car insurance one can imagine that car, km's, price, age and some minor things are important.
AI will not work like this.
AI will make a profile of many pieces information, even if they are not a subject matter and build with an algorithm a risk profile. 

What do you think is the legal difference?
Legally the insurance company will abuse your privacy rights to the limit.
They can't make a profile based on AI simply because they will use information which is not relevant for the product they sell nor is it their business to know.
An insurance company can ask you to inform them on the things they want to know. You can refuse if wished.
When an insurance company uses AI, they will probably ask you no more than your social security number and than they will come up with your car insurance...
While also taking into account that you have 2 cats, red hair and your mum has a milkman who retired 2 years earlier than the average lawyer would do. And.....

And that is only the first issue; your privacy.

The impact of AI but also blockchain will be huge.The biggest changes will be smart contracts enabled by blockchain instantaneously will authorise payments from a customer’s financial account. But also the utmost tailored insurance contract, almost fully individual, will speed up the whole chain. Well, the chain will be gone by than and fully redesigned.

FINTECHS ARE NOT DISRUPTORS

​We are in FintechFintechs should continue to lead innovations but also should keep anybody involved on the leading edge of the real focus; customer experience. Because there is no other thing that is more distinctive than this. All the rest is chewing the same beans twice...

Banks are followers by example; as they are conservative. But their role has to be as such. They will follow in innovation and products. They will bend with winds the markets move.

Are Fintech's disruptive?
Most not arguably; no! They are not disruptive in itself, they are merely the pulling horses of the existing finance and banking industry.  Fintech’s will make the mistakes, broaden the horizons and lead the way. But not by a a visionary view; but just by deploying the latest technology possibilities and -really- hope to be the next purchase of another party.

What holds them back?
From our experience and views it is the existing balanced system which holds anybody back to move to quickly into anything else.
Where “quick” is a very relative understanding. 
Don’t banks still have your trust to watch your money? Since centuries already? And aren’t it banks that rule, with our help and even wishes and laws, the financial system into the best dampened system. Where dampened doesn’t mean slow, old fashioned or not functioning but steady and trustworthy.
All things “trust” concerning are secured by regulatory barriers for newcomers to enter the financial markets. And they rightfully are.
But even when the Finch acquires a license to act as bank they have to fight to main things; the customer who really has no reason to move.
And next to that; the bank as an extreme dangerous commercial predator is awaiting the Fintech's succes; and than simply buys, duplicates or destroys. They have the money and the market…

The future of Fintech's
The future will show different banks and insurance companies. Because they will adapt.
They will adapt to what the successful Fintech’s will show is successful.
The reason of existence of a Fintech is of course replicating the wishes of the ever changing market space. Their role is one of consciousness, moving forward and leading the ways of the financial market.
But in the role of guide. Not in the role of future banks or financial system but in the role of Adjuster Not as Disruptor…

So; don’t invest in Fintech's?
Of course. We do invest. Because disruption is not the goal; but adding value is. A successful Fintech has great value to add for strategic partners. And these partners are wiling to pay for that added value; either by securing their own market or by deploying the newly  available Tech.

And looking back in at least decades; there will have been a Fintech that has hit the nail right on the button. And did change the system. But only time will tell…
It is a peoples business, not bits and bytes.

Tukkers & Achterhoekers

We hebben ervaring op vele continenten, in wel 150 landen!
En alle landen hebben zo hun zakelijke gebruiken. Je moet dit wel weten, zonder die kennis wordt zakendoen moeilijk! Alhoewel je ook mag verwachten dat de zakelijke buitenlandse partner zich ook verdiept in jouw gebruiken. 

In China is zakendoen na de bekende Nederlandse plichtplegingen(Kopje koffie?... Was het makkelijk te vinden...?) nog lang niet aan de orde. Een paar bezoeken inclusief een bezoek aan het huis van de baas is toch wel nodig. Hebt dus geen haast.
Bedenk bovendien dat het aan een Japanse groep bezoekers makkelijk te zien is wie de baas is (en derhalve aangesproken dient te worden). Het is de persoon in het blauwe pak! Trek als baas zelf ook een blauw pak aan en adviseer je medewerkers iets stemmig grijs aan te trekken....

Dichterbij huis, in het Midden Oosten bv zijn er natuurlijk de strikte regels met betrekking tot vrouwenkleding! Pas je hierop aan en draag een hoofddoek indien van toepassing. En kleedt je gewoon in je eigen kleding, een witte "Boemoes", de witte soepjurk, hoef je niet aan. Maar let wel op de regels! Wees op tijd bv.

Nog dichter bij huis zijn er nog steeds verschillen, ook al worden die kleiner.
Een Engelsman zegt niet graag nee. Eigenlijk zegt een Engelsman/vrouw altijd ja. Maar bedoeld dan nee....
Een Belg vindt ons opdringerig, ga dus relaxed met hen om... Een Deen is een beetje Nederlands, maar toch net niet! En natuurlijk is een Duitser gesteld op correctheid. Maar is bijzonde gesteld op zijn of haar positie. De Nederlandse je- en jij cultuur is daar niet populair; Herr Diplom-Kaufmann en Herr Doctor wel!
Verstandig dat dus zelf ook te gebruiken! 

En dan heel dicht bij huis?
Zakendoen dichtbij huis is dus het makkelijkst; immers heeft u boven kunnen lezen dat verschillen tussen mensen hindernissen opwerpen bij het zakendoen.

Wij hebben nu 6 jaar ervaring in Enschede. Maar wij zijn, zoals ze in Enschede zeggen, niet van "hier".

Zijn er verschillen tussen de Achterhoek en Twente en de rest van Nederland. Daar waar de rest van Nederland bestaat uit koppige Groningers, zuinige Zeeuwen, opschepperige Westerlingen en gezellige Brabanders?

Ja en nee.
Zoals we boven hebben kunnen lezen worden verschillen wel kleiner naarmate je dichter bij huis zakendoet. En Nederland is natuurlijk zelf ook al niet te groot.

Maar toch zijn er ook op een klein geografisch gebied wel kleine verschillen te herkennen met andere gebieden.

      Het antwoord is dus JA.
Maar het komt vooral in groepen voor; in de kroeg, op het voetbal veld. Het wordt gecultiveerd en bewaard. En gelukkig, want men dient trots te zijn op zijn/haar afkomst!

Als zijnde -niet van hier- zien we eigenlijk al geen verschillen tussen Achterhoekers en Tukkers. Maar wel een paar typische zaken die we kunnen kenschetsen als zijnde wel "van hier".
Een te directe benadering zorgt ervoor dat de Tukker of Achterhoeker is zijn schulp kruipt of boos wordt....
De (terechte) trots van Tukkers en Achterhoekers op hun (zakelijke) prestaties moet je niet in twijfel trekken... En goede zaken doe je dicht bij huis, bij voorkeur met mede Tukkers of Achterhoekers, maar nog liever met dorpsgenoten of vrienden...

      Het antwoord is dus Nee.
Maar al deze typeringen, trots en zaken doen dicht bij huis, gelden ook voor Groningers, Zeeuwen en Westerlingen daar waar ook de gezellige Brabander zijn kopje koffie het liefst dicht bij huis drinkt.
De redenen om dit doen liggen in de aard van de mens, niet alleen in die van de Tukker en de Achterhoeker! En trouwens ook in de aard van de Engelsman, de Arabier en de Japannees....

Rest dus eigenlijk toch maar 1 meer typische Tukkerse en Achterhoekse eigenaardigheid; de indirectheid. Dat verschilt en is van invloed op het zakendoen!
Als iedereen een beetje rekening met elkaar wil houden is de communicatie een stuk helderder.

Dus een beetje assertiever communiceren mag best; daar schrikken ze in Amsterdam, maar ook in de rest van de wereld, niet van!!
En er is genoeg om minder bescheiden over te doen!
